A review of the November election process in Nashville — conducted by state Elections Coordinator Mark Goins — found that Nashville election officials made erroneous updates to voter lists and failed to follow steps to make sure they were accurate. The Associated Press first reported on Nov. 1, 2022, that some Nashville voters were being given ballots with the wrong congressional and statehouse races. Trying to correct the problem under a tight timeframe led to over-corrections, the report states. However, the review determined that none of the errors were egregious enough to affect the outcomes of the races in which erroneous ballots were cast. The Tennessean has more on the report.

The Davidson County Elections Commission is being sued over a voting mix-up involving several precincts and the attorney general’s office will be handling the case on behalf of Metro, WPLN reports. The case was filed after more than 400 voters were given ballots for the wrong district during the November election. Elections Administrator Jeff Roberts told county commissioners this week that the mistake occurred during early voting and did not impact voters on election day. “From the [Oct.] 19th up until the first [of November], we had a group and those were given a ballot that was not consistent with the district that they should’ve been in,” said Roberts. “And then after we made some changes, we then had a few more that voted between Nov. 2 and the 5th that fell into that same category.” Those people were given a chance to vote again. However, those votes would only be counted if there was a close race or a recount, neither of which occurred. Going forward, Roberts said he will be working with the state to see how the mistake took place.

Memphis attorney Varonica Cooper was this week elected Division 2 Judge of the Memphis Municipal Court for an eight-year term, the Daily Memphian reports. Cooper faced off against eight candidates to replace Judge Tarik Sugarmon, who resigned after being elected to the Shelby County Juvenile Court. Cooper is an attorney at the Cooper Law Firm. She has been in private practice for 25 years. Prior to moving to Memphis, she worked as an entertainment attorney. She is a former professor at the Borough of Manhattan Community College.

Tennessee Gov. Bill Lee secured a quick victory on Tuesday, the Tennessean reports. The Associated Press called the race at 7:02 p.m. CST, within minutes of polls closing. With nearly 90% of the vote counted by 11:30 p.m., Lee had 65% of the vote and carried all but two Tennessee counties. Democratic nominee Dr. Jason Martin conceded the race shortly before 9:30 p.m. CST, telling supporters Lee was "kind and gracious" in his concession phone call. All four amendments to Tennessee’s constitution that were on the ballot yesterday have passed. They include: Amendment 1, which enshrines the state’s “right to work” law into the constitutional; Amendment 2, which removes a ban on clergy serving in the legislature; Amendment 3, which removes slavery as a possible punishment for a crime; and Amendment 4, which creates a line of succession for governors unable to temporarily serve. All 99 seats in the Tennessee House of Representatives and half of the 33 seats in the state Senate were on the ballot this election season. In many cases, incumbents had a lock on their races, Nashville Public Radio reports. Coverage from the station includes news about the race to succeed disgraced former House Speaker Glen Casada, the new youngest member of the General Assembly, a replacement for indicted Republican Sen. Brian Kelsey, and the likelihood of a special election in Memphis after voters re-elected state Rep. Barbara Cooper, who died in October after ballots including her name were printed. Former Maury County Mayor Andy Ogles beat Democrat Heidi Campbell in Tennessee’s 5th Congressional District, turning the district red for the first time in its recorded history and giving Republicans another seat in Congress, WPLN reports. Ogles will replace Democratic Rep. Jim Cooper, who announced he would not run for re-election after the Republican-led General Assembly changed the 5th District’s boundaries in January, splitting up Nashville’s reliably Democratic voting base. In other congressional races, both District 6 Rep. John Rose and District 7 Rep. Mark Green easily won over their Democratic challengers, Tennessee Lookout reports.

Just one hour before the polls closed last night, only 117 voters out of 438 had visited the Davidson County Election Commission office to cast a corrected ballot, the Wilson Post reports. The report was based on comments from a worker at the office. The affected voters had been given the wrong ballots during early voting. The right to cast a corrected ballot was secured through a lawsuit settled earlier this week. Those provisional ballots will be counted only in the event of a contested election, Tennessee Lookout reports.

Davidson County voters who were given the wrong ballots during early voting will be allowed to cast provisional ballots on election day after the American Civil Liberties Union of Tennessee sued local and state officials. On Friday, the group agreed to settle the suit, filed against the Davidson County Election Commission, state Coordinator of Elections Mark Goins, Secretary of State Tre Hargett and Gov. Bill Lee. The state also has published a list of those who received incorrect ballots, which can be accessed at nashville.gov. Those affected can go to the Davidson County Election Commission, 1417 Murfreesboro Pike, on Election Day to cast a new ballot. Election officials in Benton County reported that “likely fewer than 10” voters were given an incorrect ballot during early voting, the Tennessean reports. The issue appears to be tied to confusion over congressional districts. Benton is one of seven counties that contains precincts split among multiple congressional districts. Davidson and Shelby counties, which reported issues last week, are part of that group, as are Campbell, Jefferson, Scott and Tipton counties, which have not yet indicated any issues. Last week, election officials said that 212 voters in Davidson County were given the wrong ballot. That number now appears to be closer to 438. Officials in Shelby County said 50 voters were given the wrong ballot.
