News Type: Clarification

An item in Wednesday's TBA Today referenced a news story from WBIR that said that Ooltewah High School assistant principal/athletic director Allard “Jesse” Nayadley had been "sentenced" to community service for failing to report child abuse. According to his lawyer, Lee Davis, Nayadley actually had agreed to pre-trial diversion on the class A misdemeanor of failing to report. After performing the community service and 90 days of pre-trial diversion, he can have the matter expunged.

News Type: Clarification

A Tennessee bill (SB 1677 / HB 1823) would allow pharmacists to provide birth control after interested pharmacists enter into a collaborative agreement with a physician, who would oversee a series of protocols for the pharmacist to follow. An item in Thursday’s TBA Today cited a media outlet that incorrectly reported pharmacists would be able to prescribe birth control.

News Type: Clarification

An item in yesterday’s issue of TBA Today reported on a pending action in state court related to the challenge to a measure limiting abortion rights in Tennessee. On Dec. 9, Williamson County Chancery Court Judge Michael Binkley issued an order denying a motion to dismiss an action filed by state officials. It is unclear what impact this ruling will have on the ultimate outcome of the Williamson County case or the pending federal court action.

An item in yesterday's TBA Today erroneously reported that the Tennessee Court of Appeals ruled Tuesday that graphic photos from a crime scene should not have been used during trial of a Knoxville man convicted in a deadly hit and run, as reported by WATE. The decision was made by the Tennessee Court of Criminal Appeals.

A news item in yesterday’s issue of TBA Today erroneously reported from the Tennessean that “concealed carry permit holders” potentially could take firearms into the facilities where the Tennessee Titans and Nashville Predators play, due to possible conflicts with the recent opinion by Tennessee attorney regarding guns in parks. Tennessee does not require concealment of a handgun by a civilian handgun permit holder.

A WREG story referenced in yesterday’s edition of TBA Today incorrectly reported that the current wave of immigrant children are trying to become U.S. citizens. TBA Immigration Law Section Chair Bruce Buchanan points out that the children are not attempting to become U.S. citizens, but are filing for asylum and, if granted, they would become asylees. After a year as an asylee, they can apply for permanent residence (green card) and continue in that status for a number of years. At some later date — at least 5 years depending on the age they obtained the green card — they could apply to naturalize to be U.S. citizens.

A story in Friday’s issue of TBA Today, which provided a summary of lawyers who prevailed in state House and Senate party primaries, did not include the election of Nashville real estate attorney Bill Beck as the Democratic nominee to fill the seat of retiring House Democratic Caucus Chair Mike Turner. Beck defeated former Tennessee Democratic Party Executive Director Jennifer Buck Wallace and Stephen Fotopulos, a Navy veteran and former executive director of the Tennessee Immigrant and Refugee Rights Coalition. Beck will face Republican Brian Mason in the general election for House District 51. The Tennessean has more on the race.

A story in yesterday’s issue of TBA Today indicated that metro Nashville officers are responsible for checking arrestees’ immigration records under the Secure Communities program. Instead, it is the Davidson County Sheriff’s Department that is participating in the federal program and is responsible for conducting the checks.

News Type: Clarification

A motion to dismiss contempt of court charges against Hawkins County Clerk of Courts Sarah Davis, which was filed last week, has not been acted on by the judge assigned to the case and reports of Davis' exoneration are premature and “troubling,” the clerk's defense attorney tells the Rogersville Review. TBA Today reported on March 25 that the charges against Davis had been dismissed based on a story in the Kingsport Times News.
