News Type: Clarification

A story in yesterday’s issue of TBA Today reported that the Nashville Metro Council voted unanimously this week to appoint former Metro Councilmember Anthony Davis to the state House seat held by Democratic Rep. Bill Beck, who died earlier this month. Davis will serve in an interim capacity until a special general election is held in September. He will face three other Democrats in a special primary election on Aug. 3. The winner of that race will advance to the general election on Sept. 12. One Republican has picked up papers to run in the general election. The Nashville Post has more on the story.

A story in yesterday’s issue of TBA Today about two Jackson individuals prosecuted for bank fraud did not include details about the sentence for Benjamin Vargason. He was sentenced to time served and placed on supervised release for three years, with six months to be served in home confinement. A story in Friday’s issue of TBA Today reported that the Tennessee legislature approved several amendments to the Tennessee Supreme Court Rules. The story indicated that the amendments approved were the same as those put out for public comment. In fact, the court did change the rules package after the comment period. The language sent to and approved by the legislature did not include changes to Rule 41 of the Rules of Criminal Procedure. That rule was returned to the Rules Commission for further consideration. View the final changes to Rule 5.02 of the Rules of Civil Procedure and Rule 49 of the Rules of Criminal Procedure.

An article in yesterday’s issue of TBA Today indicated that the new law firm of Herzfeld, Suetholz, Gastel, Leniski and Wall (HSGLaW) will assume work on opioid litigation previously handled by Branstetter, Stranch & Jennings. In fact, the new firm will take over responsibility for neonatal abstinence syndrome (NAS) baby cases. Branstetter, Stranch & Jennings, which is rebranding as Stranch, Jennings & Garvey, will continue to handle governmental opioid work.

U.S. Supreme Court Marshal Gail Curley on Friday clarified earlier remarks about the probe into the leaked Dobbs decision saying that she questioned the nine justices but did not require them to sign sworn affidavits. Bloomberg reports that all other 97 employees who were interviewed did sign such statements. “The justices actively cooperated in this iterative process, asking questions and answering mine,” Curley said in a statement. “I followed up on all credible leads, none of which implicated the justices or their spouses.” She added that she “did not believe that it was necessary to ask the justices to sign sworn affidavits.” The TBA Today story on Jan. 19 indicated that all those interviewed signed sworn affidavits.

An item in Tuesday’s TBA Today failed to note that retired magistrate Carl Colloms was also honored by the University of Tennessee’s Alumni Association. Colloms, who graduated from the College of Law in 1966, served in a variety of legal and judicial positions in Bradley County before his retirement in 2012. Since then he has donated millions in scholarship funding to the College of Law. Read more about his career and that of the other award winners.

An article in yesterday’s issue of TBA Today omitted the names of two attorneys who have been selected for the TBA Public Service Academy. Brian Bush of Chattanooga’s Spears, Moore, Rebman & Williams PC law firm and Jessica Schultz of Schultz Law in Nashville are among the 10 attorneys who will participate in the nonpartisan training that provides attorneys with the tools to run for local public offices, such as school board, city council and county commission. The program’s two sessions will cover topics like strategy, campaign finance, work-life balance and more. Read more about this year’s class.

An item in Friday's issue of TBA Today was not clear about the groups holding a networking reception this Thursday in Nashville. The event at Pins Mechanical Company is being hosted by the Lawyers' Association for Women (LAW) - Marion Griffin Chapter and the Tennessee Stonewall Bar Association. The event will take place from from 5:30 to 7 p.m. CDT. Attendees will gather for games and libations and pizza will be provided. TBA Today last week reported that 22nd Judicial District Circuit Court Judge David Allen was honored for his role as a recovery court judge during a recent meeting of the Tennessee Association of Recovery Court Professionals. The story should also have stated that McNairy County General Sessions Judge Van D. McMahan also received the Making a Difference Award. Both judges said working with recovery courts is the “most rewarding” part of their jobs and McMahan said it was the “most important thing” he does. Also at the conference, the association recognized retired Seventh Judicial Circuit Court Judge Don Elledge with its first ever Recognition of Service Award for his long contribution to recovery courts. The Administrative Office of the Courts has more on all three judges.

An item in Wednesday's TBA Today on the recognition Nashville attorney Doug Berry received from the German government for his 17 years of service as honorary consul of the Federal Republic of Germany failed to note that he is an attorney with Miller & Martin PLLC.
