Montgomery County lawyer Christopher Wayne Barber received a public censure from the Tennessee Supreme Court on March 19 for practicing law while his license was suspended, charging an unreasonable fee, and failing to notify his client that his license to practice law had been suspended. The court found these actions violated Rules of Professional Conduct 1.3 (diligence), 1.4 (communication), 1.5 (fees), 5.5 (unauthorized practice of law), and 8.1(b) (bar admission and disciplinary matters). Memphis lawyer Homer L. Cody was publicly censured by the Tennessee Supreme Court on March 16 for representing two parties in the same action that had adverse interests against one another. Both the Tennessee Court of Appeals and the trial court ordered Cody to refrain from representation of either party, but he continued to provide legal services to one of the parties. The Supreme Court determined that the representation caused a direct conflict of interest and violated Rule 1.7 (conflict of interest), 3.1 (meritorious claims and contentions) and 8.4 (misconduct) of the Rules of Professional Conduct.
