James Franklin Logan Jr. received a public censure from the Board of Professional Responsibility. Logan, on behalf of a Limited Partnership in which he and his client were principals, attempted to foreclose on his client’s residence to recover monies the client owed to the partnership. In so doing, he violated Rules 1.7 and 1.8 because his actions were adverse to the interests of his client. Additionally, Logan violated Rule 1.6 by discussing his client’s finances with his client’s ex-wife without his client’s consent. Download the BPR notice.

James Prentice DeRossitt, IV was transferred to disability inactive status during which he cannot practice law. He may return to the practice of law after reinstatement by the Tennessee Supreme Court upon showing of clear and convincing evidence that he disability has been removed and he is fit to resume. The Tennessee Supreme Court issued an order on Sept. 26 suspending nine lawyers who have assumed inactive status but have not paid the required annual inactive status fee to the Board of Professional Responsibility. The fee is due on or before the first day of the attorney’s birth month each year. See the list of those suspended and reinstated.

Memphis lawyer Christopher Lee Brown was suspended by the state Supreme Court on Sept. 27 for failing to act diligently and failing to communicate adequately with five clients. The court also found that he accepted referrals from an unregistered intermediary organization, and failed to comply with an order from and made a false statement to a hearing panel of the Board of Professional Responsibility. The court directed Brown to make restitution to two clients and consult with the Tennessee Lawyers Assistance Program. Download the BPR notice.

On Aug. 21, the Tennessee Supreme Court suspended 130 lawyers for failing to comply with mandatory continuing legal education requirements in 2012. Attorneys who since have complied with the rule, and for whom notice has been received from the CLE Commission, are noted as reinstated.

Adam W. Parrish of Lebanon was publicly censured by the Tennessee Supreme Court on Sept. 23 for charging a fee for his services representing an indigent criminal defendant to whom he was appointed. Parrish was not entitled to charge a fee for his services following the first tier appeal without moving to withdraw during the 14-day period in which an attorney is entitled to withdraw from the appointed representation. Knoxville lawyer Raymond Andrew Shirley was suspended for one year for failing to diligently prosecute a case on behalf of his clients, comply with court-ordered discovery and settle a pending lawsuit as requested by his clients. As a result of his inactions in the matter, the case was dismissed by the trial court, of which Shirley failed to notify his clients. Download the BPR notice.
