The Tennessee Supreme Court suspended David Garrett Mullins Jr. of Wise County, Virginia, from the practice of law for one year to run concurrently with his prior disbarment. Complaints allege Mullins accepted a fee for representation in a criminal matter, and thereafter he failed to adequately communicate with his client. The complaint further alleged that he improperly advised his client to reject a plea offer and after the trial, his client was found guilty. View the BPR notice.

The Tennessee Supreme Court reinstated the law license of Hamilton County lawyer John Alley on Aug. 4. Alley had been placed on disability inactive status on June 19. He petitioned the court to reinstate his license on July 17. Download the BPR notice.

Wayne County lawyer John W. Castleman Jr. was reinstated to the practice of law on Aug. 4, subject to several conditions. He had been suspended in July 2011 for one year, retroactive to Dec. 14, 2009. Based on the recommendation from a hearing panel, the state Supreme Court reinstated the license so long as Castleman (1) continues a monitoring program for one year, including random drug screenings; (2) continues participation in a Buprenorphine program; (3) continues counseling; (4) participates in a twelve-step program; and (5) engages a practice monitor for one year. The Supreme Court of Tennessee reinstated Bruce H. Guthrie II to the practice of law on July 30. He had been suspended on July 30, 2009, for 26 months retroactive to May 18, 2007. Guthrie filed a petition for reinstatement and a hearing panel found that he had complied with the terms and conditions of his suspension. Based on the hearing panel’s recommendation, the Supreme Court reinstated Guthrie’s license to practice law. Download the BPR release.

Lebanon attorney Adam Wilding Parrish was suspended from the practice of law on July 30 and placed on probation for one year by the Tennessee Supreme Court. The discipline was imposed after the court found that Parrish failed to file the appropriate documents to perfect an appeal and failed to verify an important fact before deciding not to file a divorce action. When the client inquired as to the status of the divorce, Parrish’ s staff led her to believe the suit was proceeding. In mitigation, Parrish obtained a divorce for the client after being informed the parties never reconciled. Download the BPR release.

Charlotte Prather Milton of Memphis was suspended from the practice of law on Aug. 1 for one year. The Supreme Court found that after being paid a retainer, Milton failed to perform work, failed to communicate with clients, failed to refund the fee she had been paid and failed to return documents to the clients. She also failed to respond to the complaint filed against her, failed to respond to the petition for discipline and failed to appear at the hearing. Download the BPR release.

The Tennessee Supreme Court temporarily suspended Kentucky lawyer Edmund Victor Smith on July 25 after finding that he failed to respond to the Board of Professional Responsibility regarding a complaint of misconduct. The Tennessee Supreme Court reinstated Shelby County lawyer William T. Maxwell to the practice of law on July 25 subject to three conditions: he must engage a practice monitor for three years, undergo evaluation by the Tennessee Lawyers Assistance Program (TLAP) and comply with any recommendations from the agency. Maxwell was suspended on Jan. 7 for a period of 15 months, retroactive to July 19, 2012. On Jan. 15, he petitioned the court to reinstate his license. Download the BPR notice.

Roane County lawyer Patricia Donice Butler was suspended on July 28 for nine months, but the court allowed her to serve all but 90 days on probation so long as she completes an additional 12 hours of continuing legal education, engages a practice monitor, confers with the Tennessee Lawyers Assistance Program (TLAP) and complies with all of its recommendations. The court acted after receiving six complaints that Butler failed to act with competence and diligence, failed to adequately communicate with clients and failed to expedite litigation.
