The law license of Campbell County lawyer Jody Rodenborn Troutman was transferred to disability inactive status by the Tennessee Supreme Court on Oct. 23. Troutman cannot practice law while on disability inactive status. Read the BPR release.

McNairy County attorney Ross Neal Mitchell received a public censure from the Board of Professional Responsibility of the Tennessee Supreme Court on Oct. 19. The board determined he violated Rule of Professional Conduct 1.1 (competence), 1.3 (diligence), 1.4 (communication) and 1.16 (terminating representation), as well as Rule 8.4(c) (dishonesty, misrepresentation). The law license of Davidson County lawyer William Caldwell Hancock was reinstated Oct. 16 when the Tennessee Supreme Court vacated its Aug. 13, order that suspended him for a year. The court took this action following Hancock’s assertion that he did not receive a copy of a final judgment issued by the trial court in his appeal of the disciplinary proceeding. Bedford County lawyer Christopher Paul Westmoreland received a censure on Oct. 15 for failing to respond to requests for information from his client or file motions with the court. Westmoreland was appointed to represent a client on two criminal matters, which resulted in convictions. He neglected to timely file appellate briefs in both cases, even after being warned by the court to comply with the Rules of Appellate Procedure and the orders of the court. Read the BPR notice.

Former Rutherford County lawyer Laural Ann Axson Hemenway received a censure on Oct. 15 for engaging in conduct that was disruptive and prejudicial to the administration of justice. While working as an assistant district attorney, Hemenway stated in open court that she felt the courtroom was a “hostile environment for a female,” that the court proceedings violated her constitutional rights and that “a lot of discriminatory things” were said and done in the courtroom. Wilson County lawyer Susan Carol Parkes was censured on Oct. 14 for neglecting the cases of two bankruptcy clients and failing to communicate with them. Parkes also was found to have led her clients to believe action had been taken when it had not. And she did not take action to resolve the cases until a disciplinary complaint was filed. Clayton F. Mayo, an attorney in Madison County, received a public censure from the Tennessee Supreme Court on Oct. 14. The court found that he failed to communicate with a client, took no action on his client’s behalf and did not respond to the disciplinary complaint. In addition, the court reports that Mayo was suspended on Jan. 27, 2014, but did not inform his client and did not refund her fee. Read the BPR notice.

Davidson County lawyer John Martin Drake was censured on Oct. 14 for failing to file a brief on his client’s behalf or respond to inquiries from the Court of Criminal Appeals about the status of the appeal. The court entered an order removing Drake as counsel for these violations. The Supreme Court directed Drake to undergo an evaluation by the Tennessee Lawyers Assistance Program (TLAP) and conditioned his censure on compliance with all subsequent TLAP recommendations. Knox County lawyer Horace Maynard Brown was censured on Oct. 14 for violations of the Rules of Professional Conduct. While representing a client in a bankruptcy case, Brown failed to file a motion to approve a personal injury settlement, pay attorney’s fees to the personal injury lawyer or pay the bankruptcy trustee. The court also found that he took possession of the settlement funds, but failed to place the proceeds in a trust account or maintain records of disbursements to creditors. Finally, Brown utilized only one bank account for both his funds and client funds. Read the BPR release.
