A number of lawyers suspended for administrative violations have been reinstated to the practice of law. These include lawyers reinstated after being suspended for failing to pay the annual BPR registration fee in 2008, pay the professional privilege tax in 2010 and 2015, file the required IOLTA report in 2012, complete CLE requirements in 2015, and submit the annual fee and/or IOLTA report in 2016. The Tennessee Supreme Court suspended Andy Lamar Allman from the practice of law today after finding that he failed to respond to a complaint filed with the Board of Professional Responsibility and misappropriated funds. Because of these actions, the court determined that he posed a threat of substantial harm to the public. The suspension takes effect immediately and will remain in effect until modified or dissolved by the court. Read the BPR notice.

The Tennessee Supreme Court last week suspended 112 lawyers for failing to comply with mandatory continuing legal education requirements in 2015. Attorneys who since have complied with the rule, and for whom notice has been received from the court, are noted as reinstated. See the list of all attorneys suspended and reinstated.

The Tennessee Supreme Court today transferred the law license of Wayne County lawyer Robert Wesley Freemon to disability inactive status. Freemon may not practice law while on inactive status. He may petition for reinstatement by showing clear and convincing evidence that the disability has been removed and he is fit to resume the practice of law. Read the BPR notice.

The Tennessee Supreme Court today suspended Akron, Ohio, lawyer Terence Joseph Fairfax from the practice of law after finding that he misappropriated funds. The court also determined that Fairfax, who is licenced in Tennessee, posed a substantial threat of harm to the public. The suspension will remain in effect until dissolution or modification by the court. Read the BPR notice.

The law license of Hamilton County attorney Matthew Jack Fitzharris was transferred to disability inactive status on Aug. 23. Fitzharris may not practice law while on inactive status but may petition for reinstatement if he can show by clear and convincing evidence that the disability has been removed and he is fit to resume the practice of law. Hamilton County lawyer Michael Lee West was suspended for one year effective Aug. 17. The Tennessee Supreme Court found that West, while suspended from the practice of law, failed to withdraw from a pending case and failed to notify his client of the suspension. As a consequence, the notice of trial was sent to West, who failed to take appropriate action or inform his client of the trial date. A default judgment was therefore entered against the client. West accepted responsibility and reached an agreement to make monthly payments on the judgment. Read the BPR release.

The Tennessee Supreme Court transferred the law license of Katherine Evett Smith to disability inactive status on Aug. 16. Smith may not practice law while on inactive status. The Tennessee Supreme Court transferred the law license of Timothy Darnell Flowers to disability inactive status on Aug. 16. Flowers had previously been suspended for three years for violations of the Rules of Professional Conduct. The order transferring his license to inactive status does not affect his suspension.
