Memphis lawyer John R. Hershberger was publicly censured by the Board of Professional Responsibility yesterday. Hershberger was found to have violated the Rules of Professional Conduct by attempting to engage in an ex parte communication when he went to a judge's house to ask her a question pertaining to a case. The judge was not home. This censure does not affect Hershberger’s ability to practice law.

McMinn County attorney Larry D. Cantrell was temporarily suspended yesterday, upon finding that Cantrell poses a threat of harm to the public. Cantrell is not allowed to accept any new cases, and after March 7, must not use any indicia of lawyer or legal staff, nor maintain a presence where the practice of law is conducted. The suspension remains in effect until dissolution or modification by the Supreme Court.

A Knox County lawyer was temporarily suspended from the practice of law yesterday, after the Board of Professional Responsibility found him to pose “a threat of substantial harm to the public.” James Douglas Busch must cease representing existing clients by March 3, and may not accept any new clients effective immediately. He is required to notify all clients being represented in pending matters.

Sevierville lawyer Jerry DeWayne Kerley was disbarred today, retroactive to June 21, 2012. The Tennessee Supreme Court suspended Kerley on June 21, 2012, based upon his conviction of conspiracy to commit wire fraud, wire fraud, bank fraud, false statements and money laundering. A Board of Professional Responsibility hearing panel found that Kerley should be disbarred.

The license of Howard MacArthur Romaine of Davidson County was transferred to disability inactive status on Tuesday. Romaine cannot practice law until reinstatement by the Tennessee Supreme Court upon showing evidence the disability has been removed and he is fit to resume practice.

Campbell County Judge Amanda Sammons was today placed on a three-year probation by the Board of Judicial Conduct. The judge last year faced charges of official misconduct, but they were thrown out by Senior Judge Paul Summers, who found the state had failed to present enough proof for a jury to consider the case. Sammons agreed to the terms of her probation, which include having Criminal Court Judge Shayne Sexton serve as a mentor, and that she attend the General Jurisdiction Course at the National Judicial College at her own expense.

Jessica D. Jones of Bristol was suspended from the practice of law on Friday. Jones had failed to show cause as to why her license should not be suspended after defaulting on a loan guaranteed by the Tennessee Student Assistance Corporation.

Randy Paul Lucas of Sumner County  was publicly censured by the Board of Professional Responsibility on Friday. Lucas was found to have failed to file a transcript or brief within the time allowed during the representation of a client in an appellate proceeding. Lucas also failed to comply with deadlines when given additional time to file his transcript and brief, which resulted in the dismissal of his client’s appeal. Read the BPR notice here.

Keith Lamonte Dobbs, an attorney formerly licensed in Tennessee, was censured by the Board of Professional Responsibility on Friday. Dobbs was found to have violated the Rules of Professional Conduct by assisting a client with the filing of tax information related to probate matters after he had been suspended from the practice of law. Wendell J. O’Reilly of Williamson County received a public censure from the Board of Professional Responsibility on Friday. O’Reilly was found to have violated the Rules of Professional Conduct when he comingled personal funds in his client trust account, and failed to promptly remove the funds from the account. On multiple occasions, O’Reilly was found to have paid personal and business expenses from the client trust account. Read the BPR notice here.
