Thirty-three Tennessee attorneys and 33 out-of-state attorneys have been suspended for failure to pay the 2018 annual registration fee and/or noncompliance with mandatory IOLTA reporting requirements. See a list of all administrative suspensions here.

The Tennessee Supreme Court has entered an order of reciprocal discipline against William Lawrence McKinney, disbarring him from the practice of law in Tennessee, following his disbarment in California. The order is retroactive to June 23, 2017. McKinney must pay court costs incurred by the Board of Professional Responsibility within 90 days.

Williamson County lawyer Timothy Alan Tull received a public censure on Wednesday from the Board of Professional Responsibility, conditioned upon payment of restitution of $2,000 and engagement of a practice monitor. Tull, prior to the client’s execution of a written waiver, failed to advise the client of potential conflicts of interest or the desirability of seeking independent legal advice, and further failed to provide the client with the opportunity to seek independent legal advice. Tull also failed to reasonably communicate with another client regarding the resolution of a discovery motion and the imposition of sanctions against the client.

The Supreme Court of Tennessee today suspended Stephen Kenneth Perry of Evergreen Park, Illinois, upon finding that Perry failed to respond to the Board of Professional Responsibility regarding a complaint of misconduct. Section 12.3 of Supreme Court Rule 9 provides for the immediate summary suspension of an attorney’s license to practice law in cases of an attorney’s failure to respond to the board regarding a complaint of misconduct.

Today the Supreme Court of Tennessee temporarily suspended Knox County lawyer John Harley Fowler upon finding he failed to respond to the board regarding complaints of misconduct and posed a threat of substantial harm to the public. Section 12.3 of Supreme Court, Rule 9, provides for the immediate summary suspension of an attorney’s license to practice law in cases of an attorney’s failure to respond to the Board regarding a complaint of misconduct or posing a threat of substantial harm to the public.

Former Nashville judge Casey Eugene Moreland was disbarred today by order of the Tennessee Supreme Court, consecutive to any period of incarceration. The Tennessee Supreme Court suspended Moreland on June 5, 2018, based upon his guilty plea to obstruction of an official proceeding, conspiracy to retaliate against a witness, conspiracy to commit theft, destruction of records and tampering with a witness. The Board of Professional Responsibility instituted a formal proceeding to determine the extent of final discipline to be imposed. Moreland entered a conditional guilty plea to disbarment and any restitution ordered in United States of America v. Moreland.

The Supreme Court of Tennessee on Dec. 21 temporarily suspended Candace Lenette Williamson of Southaven, Mississippi, from the practice of law upon finding that she failed to respond to the Board regarding a complaint of misconduct. Section 12.3 of Supreme Court Rule 9 provides for the immediate summary suspension of an attorney’s license to practice law in cases of an attorney’s failure to respond to the Board regarding a complaint of misconduct.

Davidson County lawyer Allyn Rubright Gibson was reinstated to the practice of law effective Nov. 19, 2018. The Tennessee Supreme Court noted that Gibson had been placed on inactive status in October 2013 but filed a petition for reinstatement in November. The Board of Professional Responsibility stated that the petition was satisfactory and met the requirements of Tennessee Supreme Court Rule 9.

The Tennessee law license of Hamilton County lawyer Katrina Akers Davis was today reinstated by action of the Tennessee Supreme Court, pursuant to Tenn. Sup. Ct. Rule 9, § 10.8(c). Davis had been placed on inactive status in February 1996.

The Supreme Court of Tennessee today disbarred Bradley County lawyer Michael John McNulty from the practice of law and ordered him to pay restitution to one client in the amount of $1,125. He must also pay court costs within 90 days. On Jan. 29, a petition for discipline was filed against McNulty over two complaints of ethical misconduct. In the first complaint, McNulty received $1,125 for legal services but provided minimal services and ultimately abandoned the representation of the client. As a result of McNulty’s abandonment, the client was compelled to hire new counsel. In the second complaint, McNulty falsified an email communication related to a client’s matter, sending an email to a medical provider that purported to be sent from an attorney who no longer worked at McNulty’s firm. McNulty did not answer the Petition for Discipline or appear at the final hearing.
