Gregory Eric Schwartz, an attorney licensed to practice law in Tennessee and Florida, was disbarred from the practice of law on Tuesday, retroactive to Jan. 20. Schwartz’s license to practice law in Florida was revoked by the Supreme Court of Florida on Nov. 21, 2018. On Feb. 27, the Supreme Court of Tennessee entered a notice of reciprocal discipline directing Schwartz to demonstrate why the discipline imposed in Florida should not be similarly imposed here, and Schwartz provided no response.

Jerry D. Holmes Jr., a Tennessee-licensed attorney residing in North Carolina, was publicly censured on Thursday by the Supreme Court of Tennessee. The Board of Professional Responsibility filed a petition for discipline concerning one complaint of misconduct. Holmes, while administratively suspended from the practice of law in Tennessee, prepared and sent an email in which he improperly designated himself as an attorney at law in Tennessee.  Holmes executed a conditional guilty plea acknowledging his misconduct.

Jason R. Grubb, an attorney licensed to practice law in Tennessee and West Virginia, was disbarred from the practice of law today by the Supreme Court of Tennessee retroactive to May 18, 2016. Grubb’s license to practice law in West Virginia was annulled by the Supreme Court of Appeals of West Virginia based upon his guilty plea of failure to collect, account for, and pay over employment taxes. On Feb. 8, the Supreme Court of Tennessee entered a notice of reciprocal discipline directing Grubb to demonstrate why the discipline imposed in West Virginia should not be similarly imposed here. Grubb filed a response on Feb. 28, but failed to demonstrate reciprocal discipline was unwarranted.

Alabama attorney Alice Howze Martin has been reinstated in Tennessee after having been on inactive status since Feb. 11, 2013. Martin filed a petition for reinstatement on March 18, and her reinstatement begins effective to that date.

Shelby County attorney Martin Alan Weiss was disbarred by the Tennessee Supreme Court on Tuesday. As conditions of his reinstatement, Weiss must make restitution in the amount of $57,769. On Nov. 15, 2018, a petition for discipline was filed against Weiss alleging that he mis-appropriated funds from 18 personal injury settlements. When distributing the money upon settling these clients’ cases, Weiss withheld an amount sufficient to pay what each client owed to the clinic where they had been treated. Rather than paying the money that had been withheld for the clinic, Weiss kept the money for his personal use.

Florida-based lawyer Thomas W. Thompson on Monday was publicly censured by the Tennessee Supreme Court. On July 6, 2018, a petition for discipline was filed against Thompson, alleging that he committed ethical misconduct by practicing law while suspended for failing to comply with continuing legal education requirements. Thompson was suspended by the Tennessee Supreme Court on Aug. 16, 2016, for failing to comply with continuing legal education requirements. While suspended, four lawsuits were filed in Tennessee naming him as the attorney for the plaintiffs.  The lawsuits were prepared and filed by Thompson’s non-lawyer staff without his knowledge, and he has not yet withdrawn from the cases.

Davidson County lawyer Erich Webb Bailey on Monday was publicly censured by the Tennessee Supreme Court. On Oct. 4, 2017, a petition for discipline was filed against Bailey, alleging that when he represented the mother in a child custody dispute, he failed to communicate with his client and failed to appear in court when the matter was set for hearing. Bailey entered into a conditional guilty plea admitting that his actions violated the Rules of Professional Conduct. On July 17, 2017, he was temporarily suspended by the Tennessee Supreme Court for substantial noncompliance with a previous TLAP monitoring agreement. Bailey is reinstated from that suspension via the order which publicly censured him.

The law license of Robert Mark Morgan was transferred to disability inactive status by the Tennessee Supreme Court on Wednesday pursuant to Section 27.3 of Tennessee Supreme Court Rule 9. Morgan cannot practice law while on disability inactive status. He may return to the practice of law after reinstatement by the Tennessee Supreme Court upon showing clear and convincing evidence that the disability has been removed and he is fit to resume the practice of law.

On March 15, Kurt Joseph Pomrenke, an attorney licensed to practice law in Tennessee and Virginia, was suspended for nine months from the practice of law by the Supreme Court of Tennessee. Pomrenke’s license to practice law in Virginia was also suspended for nine months by decision of the Disciplinary Board of the Virginia State Bar on November 27, 2018. On March 12, the Supreme Court of Tennessee entered a notice of reciprocal discipline directing Pomrenke to demonstrate why the discipline imposed by the Disciplinary Board of the Virginia State Bar should not be similarly imposed by this court. On March 14, Pomrenke provided the court his response stating that he does not contest the reciprocal discipline.

On March 15, the Supreme Court of Tennessee reinstated Shelby County lawyer Gerald Stanley Green to the practice of law effective, Feb. 24, 2019.  Green had been suspended by the Supreme Court of Tennessee on Jan. 24, 2019, for a period of six months, with 30 days served on active suspension and the remainder served on probation with conditions. Green filed a petition for reinstatement to the practice of law, and the board found that the petition was satisfactory. Green’s probation will end on July 24.
